Shelby County Repeals Carbon Pipeline Ordinance After U.S. Supreme Court Declines Case
(KCCI) After a years-long battle, a western Iowa county is pulling back its effort to prevent carbon pipelines.
Shelby County adopted a zoning ordinance in 2022 that limited where Summit Carbon Solutions could build its proposed pipeline. Summit has argued in previous litigation that the ordinance violates federal law.
The U.S. Supreme Court denied a request last month to hear the county’s case. Shelby County had teamed up with Story County in the legal challenge.
Shelby County now says it is repealing the ordinance due to that ruling.
“The Shelby County Board of Supervisors remains firmly committed to protecting local control and, more importantly, private property rights,” the statement reads.
